These Terms of Service ("Terms") govern your access to and use of cleaningquotes.pro and any related domains operated by Ceviche Digital LLC ("CleaningQuotes," "we," "us," or "our"). By using the site, submitting a quote request, or otherwise interacting with our service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the site.
CleaningQuotes is a free lead-routing service for homeowners. When you submit a quote request, we forward your information to Lead Prosper, which distributes it to aggregator buyers (currently including Astoria, conXpros, and Service Direct), which in turn route the request to cleaning companies in their networks. Those cleaning companies contact you directly to provide quotes.
CleaningQuotes does not perform cleaning services and does not act as the agent, partner, employer, or representative of any cleaning company. We do not vet, license-check, insure, background-check, or otherwise verify any cleaning company. We make no representations about the qualifications, availability, pricing, response time, quality, or insurance status of any cleaning company that contacts you.
You must be at least 18 years old and a resident of the United States (or a jurisdiction where the service is offered) to submit a quote request. By submitting, you represent that you meet these requirements and that you are the owner of, or otherwise authorized to provide, the contact information you submit.
You agree to provide accurate, current, and complete information when submitting a quote request, and to keep that information up to date. Submitting another person's information without their authorization is prohibited.
By submitting a quote request, you electronically sign and consent to receive marketing calls, text messages (SMS/MMS), and emails from cleaning companies, the aggregator buyers (including Astoria, conXpros, and Service Direct), and their network partners regarding cleaning services, at the telephone number and email address you provide, including by automatic telephone dialing systems and pre-recorded or artificial voice messages, even if your number is on a federal or state Do Not Call list. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. Reply STOP to opt out of texts; reply HELP for help.
Our forms are integrated with TrustedForm by ActiveProspect, which captures a recording of your form session and issues a certificate as proof of consent. By submitting, you agree to that recording. See our Privacy Policy for more.
You may revoke consent at any time by following the instructions in any communication, replying STOP to texts, or contacting support@cleaningquotes.pro. Revocation applies prospectively; cleaning companies that already received your request may need to be contacted directly to opt out from their lists.
Receiving quotes through CleaningQuotes does not obligate you to hire any cleaning company. The service is free for homeowners; cleaning companies and aggregators pay to receive routed requests. Each cleaning company is an independent business. Any contract, scheduling, payment, dispute, refund, claim, damage, or service-quality issue is between you and the cleaning company. We are not a party to that relationship.
THE SITE AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THE QUALIFICATIONS, LICENSING, INSURANCE, AVAILABILITY, RESPONSE TIME, PRICING, QUALITY, OR PERFORMANCE OF ANY CLEANING COMPANY OR AGGREGATOR. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CEVICHE DIGITAL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE SERVICE OR ANY INTERACTION WITH A CLEANING COMPANY OR AGGREGATOR, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT, IF ANY, YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THIS LIMITATION APPLIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless Ceviche Digital LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with (a) your access to or use of the site or service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any dispute between you and a cleaning company or aggregator.
The site, including its design, text, graphics, logos, and other content, is owned by Ceviche Digital LLC or its licensors and is protected by U.S. and international intellectual-property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of this content without our prior written permission, except as expressly permitted by these Terms.
We may suspend or terminate your access to the site at any time, with or without notice, including if we believe you have violated these Terms or applicable law. The provisions of these Terms that by their nature should survive termination — including Sections 6 through 13 — will survive.
We may modify or discontinue the site or service at any time. We may also update these Terms from time to time; the "Last updated" date will reflect the most recent revision. Material changes will be flagged on the site where appropriate. Your continued use of the site after a change becomes effective constitutes acceptance of the updated Terms.
Governing law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
Informal resolution. Before filing any claim, you and we agree to try in good faith to resolve the dispute informally by contacting support@cleaningquotes.pro and providing a written description of the dispute and the relief sought.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service that is not resolved informally within sixty (60) days will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and judgment on the award may be entered in any court of competent jurisdiction. The arbitration will take place in Orange County, California, or by videoconference. The arbitrator, and not any federal, state, or local court, has exclusive authority to resolve disputes about the interpretation, applicability, enforceability, or formation of this arbitration agreement.
Class-action waiver. YOU AND WE EACH AGREE THAT DISPUTES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
Exceptions. Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice to support@cleaningquotes.pro within thirty (30) days of first accepting these Terms; the notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
